    Q222: What are fixed penalty notices?

    Fixed penalty notices are a means for dealing with various minor public order offences and were brought in under the Anti-social Behaviour Scotland Act 2004.

    Police officers can issue a fixed penalty notice and a fine of £40 for the following offences:

    • Breach of the peace
    • Malicious Mischief
    • Vandalism
    • Public drunkenness
    • Being in charge of child whilst drunk in public
    • Drinking in public
    • Urinating or defecating in public
    • Refusing to leave licensed premises on being requested to do so
    • Riotous behaviour while drunk in licensed premises
    • Persisting, to annoyance of others, in playing musical instruments, singing, playing radios etc. on being required to stop
