Q700: Can I move a bird's nest?

All birds and their nests are protected under the Wildlife & Countryside Act 1981 (as amended). It is an offence to take, damage or destroy or otherwise interfere with a nest while that nest is in use or being built. It is also an offence to obstruct or prevent any bird using its nest. If the birds are in danger or there is a public health and safety, disease or damage issue you should discuss the situation with Scottish Government Rural Affairs Department Landscapes & Habitats Team, 0131 244 7381 who can advise you on the best course of action. It may be necessary to apply for a licence to move a nest.
